Capital Punishment and Juvenile Offenders

This 5 page paper considers the issue of capital punishment for juvenile offenders. Over the course of the past two decades, the issue of capital punishment and its application for juvenile offenders has been at the heart of legal debates. In 1988, the United States Supreme Court, in their decision in the case of Thompson v. Oklahoma (487 U.S. 815 (1988)), argued that the use of capital punishment for minors constituted "cruel and unusual punishment" as defined by the Eighth Amendment. Just one year later, in the case of Stanford v. Kentucky (492 U.S. 361 (1989)), the Court held that the Eighth Amendment did not categorically oppose the use of capital punishment for 16 or 17 year old juvenile offenders. While some contend that permitting capital punishment blatantly violates both international law and constitutionality – asserting juveniles are often a product of their adverse environments and, therefore, should be given extensive behavioral therapy in order to assimilate back into society – others argue that adolescents who have not yet learned the difference between right and wrong should no longer be allowed to function as a civilized human being. Children Should Not Be Punished As Adults

Children are children and regardless of their crime, they are not mature enough to understand the real consequences of their actions. One argument given relates to the fact that the prison system will only further their life of crime, and therefor has proven to ineffective in deterring crime. In addition, an alternative is illustrated, whereby these violent children can be sentenced to their own institution that is not part of the average detention center, not part of the adult prison system.
